FSIS Directives - RTE Meats - Listeria m, Pathogen Prevention

RTE-01 and FSIS Directive 7120.1


FSIS Directive 7120.1 Amendment 14, Pg. 15, first 5 applications approving ACS has been issued. This directive identifies the substances that have been approved in 21 CFR for use in meat and poultry products as food additives, approved in GRAS notices and pre-market notifications, and approved in letters conveying acceptability determinations.

It is a list that anyone can access if they want to determine if they can use a particular product. Until this time the manufacturer's general populace, even if they knew about our products, would have to call the USDA to determine if ACS / Mionix products were suitable for use. With the publication of FSIS Directive 7120.1,

USDA lists products as intervention for Listeria!!

The USDA FSIS (Food Safety Inspection Service) lists ACS products in the
New Technology Information Table. Page 15, first 5 applications listed on top of page.

ACS products, (Acidic Calcium  Sulfate) have been declared suitable for use by the USDA, and can be recommended as such by consultants and industrial specialists that help develop methods for the control of pathogens in meat and poultry plants, in particular E. coli O157:H7 and Listeria monocytogenes. Our substance listing in the table of suitable ingredients is as follows: "A solution of water, lactic acid, propionic acid, and acidic calcium sulfate (solution with a pH range of 1.0-2.0)*"

This is especially significant in that the new USDA guidelines for the control of Listeria, per the final rule, became effective October 6, 2003 [see Federal Register: June 6, 2003 (Volume 68, Number 109)] [Rules and Regulations] [Page 34207-34254] and manufacturers are now being held to a much higher standard.

ACS products "RTE-01 " for the treatment of ready-to-eat (RTE) products have allowed many producers to go from Alt 3 status to Alt 2 and Alt 1!

What does this directive do?

This directive provides Consumer Safety Inspectors (CSIs) and Consumer Safety Officers (CSOs) with instructions for verifying whether establishments are complying with the regulations in 9 CFR part 430.4. Requirements for Specific Classes of Product (Attachment 5 of theInteractive Listeria Directive 10,240.4). In addition, this directive includes verification procedures for ready-to-eat (RTE) products other than those applicable to 9 CFR part 430.

 ADVANTAGES OF USING ACS PRODUCTS FOR LISTERIA DIRECTIVE 10,240.4

 

Alternative 1.  What are the regulatory requirements of 9 CFR 430.4(b)(1)?

Use of a post-lethality treatment (which may also be the antimicrobial agent or process) that reduces or eliminates microorganisms on the product AND an antimicrobial agent or process that suppresses or limits the growth of L. monocytogenes.

 Post-Lethality Treatments

  1. Acidic Calcium Sulfate - ACS - RTE-01®
  2. Post-packaging Pasteurization
  3. High pressure pasteurization
  4. Others

Antimicrobial Agent or Process

  1. Acidic Calcium Sulfate - ACS - RTE-01®
  2. Acetate/Diacetate solution
  3. Others

Acidic Calcium Sulfate - ACS - RTE-01® solutions are the only ones that appear to qualify as both a post-lethality treatment and an antimicrobial agent or process.


Alternative 2.  What are the regulatory requirements of 9 CFR 430.4(b)(2)?

Use of either a post-lethality treatment (which may be an antimicrobial agent or process) that reduces or eliminates microorganisms on the product or an antimicrobial agent or process that suppresses or limits the growth of L. monocytogenes.

If the antimicrobial agent or process is chosen to qualify as Alternative 2 then the regulation requires the additional process:

Does the establishment’s testing for verifying the on-going effectiveness of their sanitation procedures:

  1. Provide for testing of food contact surfaces in the post-lethality processing environment to ensure that the surfaces are sanitary and free of L. monocytogenes or of an indicator organism?
  2. Identify the conditions under which the establishment will implement hold-and-test procedures following a positive test of a food-contact surface for L. monocytogenes or an indicator organism?
  3. State the frequency with which testing will be done?
  4. Identify the size and location of the sites that will be sampled?
  5. Include an explanation of why the testing frequency is sufficient to ensure that effective control of L. monocytogenes, or an indicator organism, is maintained?


If a post-lethality treatment is used as qualification for Alternative 2, then the above (1-5) additional verification is not required. Acidic Calcium Sulfate - ACS - RTE-01® solutions can qualify as a post-lethality treatment for Alternative 2 now, and pending validation of suppression of growth during shelf life, qualify for Alternative 1.

If you are currently using a Acetate/Diacetate solution in your RTE meats:

  1. Using ACAcidic Calcium Sulfate - ACS - RTE-01®  solutions can qualify immediately as an Alternative 1 in the short term.
  2. In the long term, if studies validate the suppression of growth of Acidic Calcium Sulfate - ACS - RTE-01®  by itself, the acetate/diacetate solution can be removed.
  3. Our studies have shown that the addition of Acidic Calcium Sulfate -  RTE-01®  to acetate/diacetate solutions can synergize the suppression of bacteria
